NEW RETAILER CONTRACT

The current contract between the Oregon State Lottery and Lottery Retailers will expire at the end of June 2010. In anticipation of this date, the process for creating a new contract has already begun. As you know, this is a public process that allows for support from anyone. A primary concern is that you, our Retailer, have adequate opportunity to provide input relative to this document. The time line that we have created will hopefully provide ample time for your comments and suggestions. Here is a high level overview of the time line related to the Oregon Lottery retailer contract:

July 14, 2009, a Rulemaking packet was filed with the Secretary of State.

August 1, 2009, the “Notice of Rulemaking Hearing” will be published in the Secretary of State Bulletin.

August 18, 2009, there will be a public hearing from 9:00 a.m. to 1:00 p.m. at the Salem Armory Auditorium, 2310 17th St., Salem.

Written testimony and comments will be accepted until 5:00 p.m. on October 16, 2009.

At the October 30, 2009, Commission meeting, the Lottery Commission may adopt the 2010 contract with any modifications.

From December 2009 to April 2010, your field sales representative will visit you to explain any changes in the new contract and solicit your agreement and signature.

June 27, 2010, the new contract becomes effective.

RULES & STATUTES

Administrative Rules related to Lottery can be found in OAR Chapter 177.  Rules relating specifically to the Retailer Contract are found mostly in Divisions 40, 45, and 200.  Statutes relating to the Oregon State Lottery are found in ORS Chapter 461.  Links to the Secretary of State’s official web site for rules and statutes are found below.  Please be sure to review the site’s policy for updates.

Wheelchair Accessibility Information (486Kb PDF)
Lottery games must be accessible to persons who use wheelchairs.  This document gives you some background information and the specs from the Federal Americans with Disabilities Act, Accessibility Guidelines.  This is a critical issue. As you will see on the Application Checklist document, there are a number of forms the Lottery will ask you to complete when applying for a Retailer Contract.  There are also documents you may need to complete from time to time in order to maintain your Retailer Contract.  Some of these forms are available to download and print (see below).  Most forms are not yet available on this web page.  We will be adding forms as soon as we can adapt them to the right format and provide clear written instructions for their use.

The purpose of this form is for you to show the Lottery that you are compliant with Federal Taxes.

Affidavit for Stolen Scratch-it Tickets (536Kb PDF)
If so directed by Lottery staff, the purpose of this form is to file an affidavit for stolen Scratch-it tickets.

This document will show you, in general, the forms we require applicants to complete, and other documents they must submit with their applications.  When you contact the Lottery about an application, we will ask you a variety of questions and then personalize an Application Checklist for you.  Before you can submit an application, you must provide all forms and documents listed on this checklist. Application for Retailer Contract(77Kb PDF)
All prospective Applicants (as defined on OAR Chapter 177, Division 40) must complete this form as part of an application for a Retailer Contract. Read the general instructions on this form carefully. If you do not understand the requirements, please ask your Field Application Representative. All questions must be answered completely. Under Oregon Revised Statute 461.700, you are required to disclose all information relating to any criminal offense, traffic crime or violation; failing to do so will likely result in the denial of your application. The most common mistake applicants make on this form is failing to disclose an arrest or conviction. (Do not use White out). If you make a mistake, please single line through the mistake, make the correction then initial and date.

Authorization to Release Financial Records and Credit, Character and Personal History Information. (32Kb PDF)
The purpose of this form is for Lottery to obtain financial records, credit, character and personal history information on you and/or your company.

Organization Change Application (156Kb PDF)
If you are a Retailer, and you are making a change such as hiring a new manager, selling some stock, electing new officers, changing to a corporation or other entity, then you will need this form to start.  Please give us a call when you’re preparing to make this type of change and we’ll let you know what else you need to do.

Personal Disclosure (84Kb PDF)
All Key Persons (as defined on OAR Chapter 177, Division 40) must complete a Personal Disclosure form as part of an application for a Retailer Contract.  Read the instructions on this form carefully. If you do not understand the requirements, please ask your Field Application Representative. All questions must be answered completely. Personal Guarantee Form (400Kb PDF)
The purpose of this form is to ensure the Lottery will be guaranteed payment of funds by an individual of the entity.

All Retailers and other Key Persons who have completed a Personal Disclosure packet within the past year, must complete and submit this Personal Re-submission form with each subsequent application.

Some applicants may qualify for a Temporary Retailer Contract.  You can find the specific criteria in OAR Chapter 177, in Division 40 by selecting the link above.  The standard, regular Retailer Contract is here as well.  To save time, a Retail Contract Administration staff person may ask some persons to download, print, and complete and sign one of these Contracts.  If that happens, you will need to complete the Signature Page, and all Video LotterySM applicants must complete Exhibit C as well.  We encourage you to read these documents thoroughly and carefully.  When you sign them, you are engaging in a contract with the State of Oregon through the Oregon State Lottery and you are obligating yourself, legally and financially.  Treat it as you would any other contract, and be certain that you understand the terms.

Substitute W-9 Form (805Kb PDF)
The purpose of this form is to ensure the Lottery has your correct Federal Taxpayer Identification Number for reporting purposes.

Statement of Funding (75Kb PDF)
The purpose of this form is for you to show the Lottery how much money is required for you to open and operate this business, and where that money comes from. The Lottery may not contract with you if you do not have adequate funds to operate and maintain the business, or if your funding is from a prohibited or unacceptable source.

The purpose of this form is to ensure your business is compliant with OAR 177-40-070.

Video Lottery Retailers – Option A/B (8Kb PDF)
Once each business year, your Oregon Lottery® retailer contract gives Video LotterySM retailers the opportunity to choose a compensation option (“A” or “B”) for the upcoming business year. If you choose to stay with your current commission option, no action is needed. If you wish to choose a new Video LotterySM compensation option, you must submit this signed option election form.
